By using any of the services Absolute IT Solutions provides, you agree to observe all of the revisions of these Terms of Service and of Absolute IT Solutions's Operating Rules as they may be in effect from time to time. No acceptance of any purchase order from you shall constitute acceptance by Absolute IT Solutions of the preprinted Terms in the purchase order. These Terms of Service supersedes any usage of trade and control all course dealing between Absolute IT Solutions and you.

Unless contracted by separate agreement, in writing, under no circumstances does Absolute IT Solutions assume responsibility for the loss of information in the Customers account. The Customer is responsible for backup of all customer-specific information located on both Public and Dedicated servers, and is responsible for rebuilding their environment in the event of loss of this information caused by failure of the server, or by any act, by any party, whether accidental or intentional.

Use of this account to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engage in any kind of illegal activity is expressly prohibited. The Customer will abide by all the rules, regulations and policies of those networks and computer systems accessed via this account whether operated by Absolute IT Solutions or not. If the Customer is unsure of those policies, it is the Customer's responsibility to ascertain said policies. The Customer agrees to indemnify and hold Absolute IT Solutions harmless from any claims resulting from the Customer's use of the service which damages either the Customer or another party or parties.

The Customer is responsible for any and all fixed and accumulative charges for this account. The account setup fee and your first month service fee will be charged to the Customer immediately. Each month, on the date that the Customer's account is considered functional by Absolute IT Solutions, the account will be charged the monthly access and any other fees for the new month plus any accumulated charges for the past month.

If you deliver any equipment to connect to Absolute IT Solutions's network at Absolute IT Solutions's premises, you will have only a license to occupy a space that Absolute IT Solutions may assign or reassign from time to time, and no bailment, rental agreement, or lease is created. The license does not confer upon you any right to enter Absolute IT Solutions's premises. If the Customer chooses to have root access to their Dedicated Server, the Customer is totally responsible for the ongoing stability and operation of their server. Any assistance by Absolute IT Solutions staff with the server of a Customer with root access may be subject to a fee.

The Customer agrees that Absolute IT Solutions has the right to suspend or cancel an account for any reason, including without limitation the investigation of policy or agreement violations, inappropriate use, use of excessive system or network resources, or nonpayment of service fees. In the event that Absolute IT Solutions suspends or cancels an account, Absolute IT Solutions will make a reasonable effort to notify the Customer of the act prior to the actual event.

All setup fees and the first month's recurring fees are non-refundable, unless the Customer is unsuccessful in using the account and notifies Absolute IT Solutions, in writing, within thirty days of establishing said service. In the event of a cancellation in the first thirty days, the Customer is liable for any and all expenses incurred by Absolute IT Solutions in establishing the Customer's account. Beyond the initial thirty day period, any fees paid are refundable at Absolute IT Solutions's discretion.

LIMITED LIABILITY. Any liability of Absolute IT Solutions, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay or operation or transmission, communications line failure, theft or destruction of, or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the Customer to Absolute IT Solutions for the current month.

All cancellations of service or changes in service must be in writing to Absolute IT Solutions Communications, Inc..

By the use of a Absolute IT Solutions account the Customer accepts the terms and conditions set forth in this agreement
